Contacts:


We process your personal data in relation to delivering our services to our customers. In relation to this we process information about you, if you are employed by one of our customers or have another relation to these. We collect these personal data when you act on behalf of your employer/our customer for this, e.g. entering into contracts, delivering of services and general contact.


Additionally, we process your personal data for customer management, e.g. invoicing and customer communication.


Pitch and presentations


Your personal data is also processed for the purpose of contacting you regarding new business. We process your personal data in relation to our pitches, proposals and presentations.

  • In order for us to pursue our legitimate interest, we process ordinary personal data, as mentioned in the second column, on the basis of article 6.1.f. Our legitimate interest are

Movie productions


Contracts


We process personal data when entering into contracts with actors and the crew for the production. We may also process personal data on landlords of locations for productions.


 


Recordings


We process personal data when we create videos, e.g., commercials or testimonial videos (interviews) for our customers. We edit the recordings into complete movies or printable material and store the raw material and complete movies.

Legal basis for the processing


We process your personal data on the following legal bases:



  • In order for us to administer our contract with you regardless of whether it is with you as an actor, a crew member or landlord of locations, we process your contact information on the bases of article 6.1.b.

  • We also process your contact information and account- and registration number on the basis of article 6.1.c for the purpose of invoicing as well as paying for your services. The processing is therefore necessary for Us to comply with a legal obligation. The legal obligation follows form the Danish Bookkeeping Act.

  • In order for Us to pursue our legitimate interests, we process information about your date of birth, age, gender, nationality, job history, resume and photographs or video of you on the basis of article 6.1.f.

    • In relation to recruiting for a movie, our legitimate interests consist of finding the right person to the job.

    • In relation to recordings, our legitimate interests consist of the establishment, exercise or defence of legal claims, i.e. the license obtained from model contracts.




Sensitive personal data



  • We can process sensitive personal data about you in relation to a movie or a commercial, if you for example participate in a movie, where you talk about a course of an illness that you have gone through. This could be in relation to a commercial for one of our clients. Our processing of personal data is based on article 9.2.f in relation to the utilization of a right to use the recordings, where you for example talk about a course of an illness that you have experienced, i.e. the license obtained from model contracts.


National identification and social security number



  • In relation to shoots abroad, there might be a need for Us to coordinate and order tickets for flights, where copies of passports are needed. In that regard we can process information about your national identification and social security number for the purpose of planning and administering the travel. Our processing of your national identification and social security number is based on consent, cf. Section 11(2)(2) of the Danish Data Protection Act.

Purpose #4


Recruitment for focus groups/interviews


We process personal data when we arrange focus groups/interviews for our clients. The personal data is collected in order to manage contact with participants in focus groups/interviews.   


 


Material from focus groups/interviews


Personal data collected from focus groups/interviews in order to be used for marketing material and to optimise campaigns, products etc. Information is collected e.g., through photograph and video. Video sequences are edited into complete videos or other types of presentation material. We retain both the raw material and final productions.

  • We also process your contact information and account- and registration number on the basis of article 6.1.c for the purpose of invoicing as well as paying for your services. The processing is therefore necessary for Us to comply with a legal obligation. The legal obligation follows form the Danish Bookkeeping Act.

  • In order for Us to pursue our legitimate interests, we process information about your date of birth, age, gender, nationality, job history, resume and photographs or video of you on the basis of article 6.1.f.

    • In relation to recruiting for a movie, our legitimate interests consist of finding the right person to the job.

We especially use Facebook for social media marketing, and therefore we and Facebook jointly control the processing of personal data about you, when you visit our Facebook page.

Furthermore, we use LinkedIn Lead Forms to share our content. The information we collect, when you sign up to receive our content via these forms, is used to register you as a receiver of our newsletter. When you sign up via these forms or when you visit our LinkedIn Page, we and LinkedIn will jointly control the processing of personal data about you. Further, personal data collected from LinkedIn Lead Forms for the purpose of our newsletter will be processed for as long as you are active and up to one year from our last communication with you.

Job applicants

Purpose #7


Job applications:


We will process your personal data in relation to our recruitment. This covers both unsolicited applications, applications from recruitment agencies as well as applications which we receive based on a job advert.


Your personal data is processed for the purpose of ensuring visitation and selection of the right person for the job position. If you apply unsolicited, our processing of your personal data will first of all take place in order to determine whether we have a vacant position, in which case it is relevant to assess your qualifications and experience.

  • In order for Us to pursue our legitimate interests in recruiting and hiring the right applicant, we can process your personal data on the basis article 6.1.f.

  • In cases, where you consent to our continued storing of your application (as specified under "Data retention"), we will continue to process your personal data on the basis of article 6.1.a (Consent).

Data retention


We will retain personal data processed for the purpose of recruitment for as long as necessary.


Unsolicited applications:


Unsolicited applications will be deleted when Advance has informed the applicant that there is currently no vacant position. If the applicant is offered to participate in a recruitment process, the applicant's personal data is stored as described below in relation to solicited applications.


Solicited applications:


Once the recruitment process has been completed and the job position is filled, Advance will delete all information relating to job applicants who was not hired.


The information will be deleted no later than six months after Advance has received the information unless Advance obtains the applicant's consent for the continued storage hereof.


In such case, the information will be deleted after three years at latest.

3. CONSEQUENSES OF THE PROCESSING

A majority of the personal data processed in accordance with this Privacy Policy happens solely for the purpose of customer managing and based on regular performance and management purposes. These processing activities will generally not have any negative consequences for you. However, a processing of personal information about you may have negative consequences in the sense that we will not be able to provide you with our services.

4. TRANSFERS TO COUNTRIES OUTSIDE THE EU/EEA

In some cases, We will be transferring personal data to countries outside the EU/EEA.


We may transfer personal data to countries that have been deemed by the Commission of the European Union to have an adequate level of protection of personal data. If the country/countries has/have not been deemed by the Commission of the European Union to have an adequate level of protection of personal data, We will provide appropriate safeguards for the transfer through the use of "Model Contracts for the Transfer of Personal Data to Third Countries", as published by the Commission of the European Union, or any other contractual agreement approved by the competent authorities. 5. YOUR RIGHTS

You have the following rights:



  • You have the right to request access to, rectification or erasure of your personal data.

  • You also have the right to have the processing of your personal data restricted.

  • If processing of your personal information is based on your consent, you have the right to withdraw your consent at any time. Your withdrawal will not affect the lawfulness of the processing carried out before you withdrew your consent. You may withdraw your consent by contacting us af gdpr@advance.dk.

  • You have the right to receive your personal information in a structured, commonly used and machine-readable format (data portability).

  • You may always lodge a complaint with a data protection supervisory authority, e.g. The Danish Data Protection Agency.


Furthermore, you have the right to object to processing of your personal data as follows.



  • If processing of your personal data is based on article 6.1.f., see above regarding legal basis, you have the right to object, on grounds relating to your particular situation, at any time to the processing of your personal data.

  • Where your personal data are processed for direct marketing purposes, you have the right to object at any time to the processing of personal data about you for such marketing.
